1. Acceptance of Terms

By accessing, browsing, or using CreatorBlade (the "Service"), operated via the website creatorblade.com, you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and our Disclaimer (collectively, the "Agreement"). If you do not agree to all of these Terms, you must not use the Service.

These Terms apply to all users, including visitors, registered users, and paid subscribers. We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the Service. Your continued use of the Service after any changes constitutes acceptance of the revised Terms. If you disagree with any modification, your sole remedy is to discontinue use of the Service.

You represent and warrant that you are at least 16 years of age (or the age of majority in your jurisdiction, whichever is greater) and have the legal capacity to enter into this Agreement.

2. Description of Service

CreatorBlade provides tools, calculators, and resources for content creators, including but not limited to:

• Earnings calculators for various platforms (YouTube, TikTok, Twitch, Instagram, and others)
• AI-powered content creation tools (title generators, description writers, script generators, faceless video creator, etc.)
• SEO analysis and optimization tools (Channel SEO Audit, SEO Studio, keyword tools)
• Analytics, trending data, and growth tools
• Browser extension for YouTube analytics

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notice or liability. We do not guarantee continuous, uninterrupted, or secure access to the Service. The Service may be subject to scheduled and unscheduled maintenance, upgrades, or other interruptions.

3. User Accounts

3.1 Account Creation

Some features require account registration. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security and confidentiality of your password and account
• Accept full responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized access or use of your account
• Not create multiple accounts for fraudulent or abusive purposes

3.2 Account Termination

We may suspend or terminate your account immediately, without prior notice or liability, at our sole discretion, for any reason whatsoever, including but not limited to violation of these Terms, fraudulent activity, abusive behavior, or chargebacks. Upon termination, your right to access the Service ceases immediately, and any unused credits are forfeited. You may delete your account at any time through your account settings.

4. Credits, Subscriptions, and Payments

4.1 Credit System

CreatorBlade operates on a credit-based system. Credits are required to use AI-powered tools and certain premium features. Each tool consumes a specific number of credits per use. Credit costs per tool are displayed before use and may change at our discretion.

• Free accounts receive a limited number of credits upon registration
• Credits do not expire while your account is active
• Credits are non-transferable between accounts
• Unused monthly subscription credits do NOT roll over to the next billing period
• Credits consumed by tools are deducted immediately upon use, regardless of output quality

4.2 Subscription Plans

Paid subscriptions (Creator Pro, Business) provide monthly credit allocations and additional features, including ad-free experience and priority support.

• Subscriptions renew automatically at the end of each billing period unless cancelled
• You may cancel at any time — cancellation takes effect at the end of the current billing period
• We reserve the right to change pricing with 30 days' written notice
• Price changes do not apply to the current billing period

4.3 Credit Packs

One-time credit pack purchases are available. Credit packs are added to your account immediately and remain valid while your account is active.

5. Refund Policy

5.1 Subscription Refunds

• 14-Day Money-Back Guarantee: New subscribers may request a full refund within 14 days of their initial subscription purchase if they are not satisfied, for any reason
• After the 14-day period, refunds for the current billing period are available only if a documented technical issue prevented you from using the Service
• Partial-month refunds are not available for cancellations after the 14-day window

5.2 Credit Pack Refunds

• Unused credit packs may be refunded within 14 days of purchase
• Partially used credit packs are not eligible for refund
• Credits lost due to tool malfunction will be restored to your account upon verification

5.3 Tool Malfunction Credits

If a tool consumes credits but fails to deliver output due to a technical error on our end (server error, timeout, AI service failure), we will restore the credits to your account upon request. Contact us at support@creatorblade.com with your account email and a description of the issue.

5.4 How to Request a Refund

To request a refund, email support@creatorblade.com with the subject "Refund Request" and include your account email, purchase date, and reason for the refund. Refunds are processed within 5-10 business days to the original payment method.

5.5 Non-Refundable Items

• Credits consumed on tools that functioned correctly (even if you are dissatisfied with the AI output quality)
• Refund requests made more than 14 days after purchase (except for documented technical issues)
• Accounts terminated for Terms of Service violations
• Chargebacks — filing a chargeback instead of contacting us will result in immediate account termination

6. Acceptable Use Policy

You agree NOT to:

• Use the Service for any unlawful, fraudulent, or malicious purpose
• Attempt to gain unauthorized access to any part of the Service, other accounts, or our systems
• Interfere with, disrupt, or overload the Service, servers, or connected networks
• Use automated tools, bots, scrapers, or scripts to access or extract data without written permission
• Share, resell, sublicense, or redistribute your account access or credits
• Upload malicious code, viruses, spam, or harmful content
• Harass, abuse, threaten, or harm other users or our staff
• Circumvent or attempt to circumvent the credit system, rate limits, or usage restrictions
• Use our AI tools to generate content that is illegal, defamatory, hateful, sexually explicit, or promotes violence
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service in a way that infringes any third-party intellectual property rights
• Violate any applicable laws, regulations, or platform terms of service

Violation of this Acceptable Use Policy may result in immediate account suspension or termination without refund, at our sole discretion. We reserve the right to cooperate with law enforcement authorities regarding violations of applicable law.

7. Intellectual Property

7.1 Our Intellectual Property

All content, features, functionality, design, code, trademarks, logos, and technology of CreatorBlade are owned by us and protected by copyright, trademark, patent, trade secret, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any of our intellectual property without our prior written consent.

7.2 AI-Generated Content Ownership

Content generated using our AI tools (titles, descriptions, scripts, hashtags, images, etc.) is provided for your personal and commercial use. However:

• We make no representation regarding copyright ownership of AI-generated content — the legal status of AI-generated works varies by jurisdiction
• You may not claim the AI tool itself or our Service as your own creation
• You are solely responsible for ensuring AI-generated content does not infringe third-party rights
• We retain the right to use anonymized, aggregated data about tool usage for service improvement

8. IMPORTANT DISCLAIMERS

8.1 "AS IS" and "AS AVAILABLE"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY INFORMATION OR RESULTS
• THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE
• THAT DEFECTS OR ERRORS WILL BE CORRECTED
• THAT THE SERVICE IS FREE OF VIRUSES OR HARMFUL COMPONENTS
• THAT RESULTS OBTAINED FROM USE OF THE SERVICE WILL BE ACCURATE, RELIABLE, OR MEET YOUR EXPECTATIONS

8.2 Third-Party Platform Disclaimer

CreatorBlade is NOT affiliated with, endorsed by, sponsored by, or in any way officially connected with YouTube, Google, TikTok, ByteDance, Twitch, Amazon, Instagram, Meta, Facebook, Twitter/X, Kick, Rumble, or any other platform. All platform names, logos, and trademarks are property of their respective owners. Our tools use publicly available information and may not reflect current platform policies, rates, or features.

9. LIMITATION OF LIABILITY

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND
• LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITIES, OR OTHER INTANGIBLE LOSSES
• DAMAGES RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE
• DAMAGES RESULTING FROM ANY DECISIONS MADE BASED ON OUR CALCULATORS, TOOLS, OR AI-GENERATED CONTENT
• DAMAGES FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA OR TRANSMISSIONS
• DAMAGES FROM THIRD-PARTY CONTENT, SERVICES, OR CONDUCT
• DAMAGES FOR LOSS OF ANTICIPATED EARNINGS, SUBSCRIBERS, VIEWERS, OR BUSINESS OPPORTUNITIES
• DAMAGES ARISING FROM TOOL MALFUNCTION, INACCURATE RESULTS, OR SERVICE DOWNTIME
• ANY MATTER BEYOND OUR REASONABLE CONTROL

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID US IN THE 12 MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100 USD).

THIS LIMITATION APPLIES REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR EXCLUSION OF LIABILITY FOR CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE LIMITATIONS MAY NOT APPLY, AND YOU MAY HAVE ADDITIONAL RIGHTS.

10. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless CreatorBlade and its owners, operators, affiliates, licensors, service providers, employees, agents, officers, and directors from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms or any applicable law
• Your use of the Service, including any data or content you submit
• Your violation of any third-party rights (including intellectual property, privacy, or publicity rights)
• Any content you create, generate, publish, or distribute using our tools
• Your negligent or wrongful conduct
• Any disputes between you and third parties arising from your use of the Service
• Any claims that AI-generated content produced through our tools infringes third-party rights

11. DISPUTE RESOLUTION & ARBITRATION

11.1 Informal Resolution

Before initiating any formal legal proceeding, you agree to first contact us at support@creatorblade.com and attempt to resolve the dispute informally for at least 30 days. Most concerns can be resolved quickly through direct communication.

11.2 Binding Arbitration

If we cannot resolve a dispute informally within 30 days, any dispute, claim, or controversy arising out of or relating to these Terms, the Service, or the relationship between you and CreatorBlade shall be resolved by binding individual arbitration, rather than in court, except that either party may assert claims in small claims court if the claims qualify.

11.3 Class Action Waiver

YOU AND CREATORBLADE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.

11.4 Jury Trial Waiver

BY USING THE SERVICE, YOU AND CREATORBLADE EACH WAIVE THE RIGHT TO A TRIAL BY JURY FOR ANY DISPUTE ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICE.

12. User Responsibilities

You acknowledge and agree that:

• You are solely responsible for verifying any information before relying on it
• You will not use our estimates as the sole basis for financial or business decisions
• You understand that earnings, views, and engagement vary based on many factors we cannot predict or control
• You will comply with all platform terms of service when using content generated by our tools
• You are responsible for the legality, accuracy, and appropriateness of content you create using our tools
• You will review and edit all AI-generated content before publishing or using it
• You will not hold us responsible for any losses arising from your use of the Service
• You will maintain the security of your account credentials

13. Third-Party Services and Links

Our Service may contain links to, or integrations with, third-party websites, services, APIs, or advertisements. We are not responsible for the content, policies, practices, availability, reliability, or security of any third-party services. Your use of any third-party service is entirely at your own risk and governed by their respective terms and policies. We do not endorse any third-party services unless explicitly stated.

14. Service Availability and Modifications

We reserve the right at any time to modify, update, suspend, or discontinue the Service (or any part thereof) temporarily or permanently, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service. We do not guarantee any specific uptime or availability. Tool features, credit costs, and capabilities may change without notice.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes are effective immediately upon posting unless otherwise stated. For material changes, we will provide at least 30 days' notice via email or a prominent notice on the Service. Your continued use of the Service after changes are posted constitutes acceptance. If you disagree, you must stop using the Service.

16. Severability

If any provision of these Terms is found to be unenforceable, invalid, or illegal by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it shall be severed. The remaining provisions shall remain in full force and effect. The unenforceability of any provision does not affect the enforceability of the remaining Terms.

17. Force Majeure

We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemics, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, shortages of resources, failures of third-party services (including AI providers, hosting services, and APIs), power outages, internet outages, cyberattacks, or governmental restrictions.

18. Waiver

No waiver by CreatorBlade of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

19. Entire Agreement

These Terms, together with our Privacy Policy, Disclaimer, and any other legal notices or agreements published on the Service, constitute the entire agreement between you and CreatorBlade regarding your use of the Service and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral.

20. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where CreatorBlade operates, without regard to its conflict of law provisions. Any legal action or proceeding not subject to arbitration shall be brought exclusively in the courts of that jurisdiction.
